(B) Civil Procedure Code (V of 1908), O.7, Rule 11(d) Hindu Marriage Act (XXV of 1955), Sec.9 Family Courts Act (66 of 1984), Sec.10 Scope Subject to the provisions of Family Courts Act, the provisions of Civil Procedure Code shall apply.
Ratio(s) Decidendi
It is the duty of the trial Court to read the plaint, not formally, but on a meaningful way and on such reading it is manifestly vexatious and meritless in the sense of not disclosing a fair right to sue, it should exercise its power exercisable under O.7, Rule 11, C.P.C.
The provision of Civil Procedure Code shall apply subject to the provsions of the Family Court Act.
