(A) Bombay (Mumbai) Municipal Corporation Act, 1988, Sections 351, 354-A -W.P. by respondent alleging appellant constructing temple in crowded area without permission from Corporation — Bombay Municipal Corporation issuing stop work notice under Section 354-A of Act to stop construction of columns on temple’s rear side — Application by appellant for regularisation of temple building — High Court passing order to domolish entire illegal and unauthorised construction — Said order stayed — Appellant’s grievance, show cause notice not issued, opportunity not given — Power under Section 351(2), to be exercised only by the Municipal Commissioner — Discretion with the Municipal Commissioner whether or not to order demolition — High Court cannot impede the exercise of that discretion by the issuance of a mandatory order — Commissioner directed to decide the question.
